Driver Charged in Tracy Morgan Crash Pleads Not Guilty

The truck driver charged in the fatal crash on the New Jersey Turnpike that critically injured comedian Tracy Morgan and hurt several other people pleaded not guilty at his first court appearance Wednesday. Kevin Roper was arraigned in state Superior Court on charges of vehicular homicide and assault by auto. Pat Battle reports.

Tracy Morgan's condition has been upgraded following the New Jersey Turnpike accident that killed Morgan's friend and mentor James "Jimmy Mack" McNair over a week ago. 

Morgan's spokesman says the comedian and "30 Rock" and "Saturday Night Live" star is now in fair condition, a "great improvement" after he was critically injured in the June 7 crash. 

"His personality is starting to come back as well," representative Lewis Kay said. 

Morgan suffered a broken leg, a broken nose and several broken ribs after a tractor-trailer slammed into the back of Morgan's limo, causing it to flip and slide into several other vehicles. 

McNair was mourned at a funeral in Peekskill last week

Two other passengers, assistant Jeffrey Millea and comedian Ardie Fuqua Jr., were seriously injured, and another, Harris Stanton, was treated and released from the hospital.

Millea's condition has also been upgraded to fair, his wife said through Morgan's spokesman. 

The limo was headed to New York City after a show in Delaware. 

The truck driver, Kevin Roper, pleaded not guilty to vehicular homicide and assault by auto charges Wednesday in state Superior Court. A criminal complaint alleges that he hadn't slept for 24 hours before the accident.
