A Miami Shores man is behind bars after police say he tried to grab a teen girl while sitting in his car but was thwarted by a rock-throwing Good Samaritan.
Luis Alberto Hernandez, 40, is charged with battery after he was arrested Wednesday, according to a Miami Police arrest affidavit.
Miami-Dade Judge Diana Gonzalez-Whyte set his bond at $100,000 Thursday. A public defender representing Hernandez at the hearing objected to the amount, saying it is tantamount to no bond.
Hernandez said in bond court that he never touched the girl, before he was silenced by the public defender. He also insisted that he did not do anything.
“I never got out of my car. They broke my window of my car,” he said at point before cursing, which he did multiple times during the hearing.
According to the arrest affidavit, Hernandez approached the 13-year-old victim at 447 NW 58th St. and in a low voice asked for directions. The girl couldn't hear him so she got closer to give him the directions.
But after Hernandez was given the directions, he refused to leave and started telling the girl she was pretty and asked if she had a boyfriend, the report said.
When the girl tried to walk away from Hernandez, he grabbed her arm against her will and tried to pull her against himself, the affidavit said.
The girl's friends and witnesses saw what happened and came to her aid. One man grabbed a rock and threw it into Hernandez's back windshield, prompting him to let her go, the report said.
Hernandez flagged down some officers and told them someone had busted his car window, but when police investigated they discovered he had grabbed the girl, the report said.
Hernandez denied grabbing her but admitted to asking her for directions and telling her she's beautiful, the affidavit said.
Gonzalez-Whyte ordered Hernandez to not have any contact with the girl.
Hernandez’s parents, Gisele and Juan Hernandez, told NBC 6 they don’t believe the allegations against their son.
Juan Hernandez said the last thing a father wants to hear is that his son is in jail.
