Police Make Arrest in Sexual Assault At Miami Beach's Fontainebleau Hotel

Police investigating sex assault report at 44th Street and Collins Avenue

Miami Beach Police said they made an arrest Thursday for a sexual assault at the famed Fontainebleau Miami Beach hotel.

Rafael Munguia, 26, was arrested and faces a sexual battery charge. He confessed to raping a 23-year-old hotel guest visiting from Beverly Hills, according to police.

Munguia was a Fontainebleau guest visiting from Mexico. He was drunk and wandered onto the 15th floor where the sleeping woman had left her door open for a friend. Munguia then raped her and left his hat behind, according to authorities.

The woman was able to escape next door to her sister's hotel room, police said.

Munguia was spotted on hotel video and apprehended within seven hours.

Police previously said they were interviewing two subjects, who they called "persons of interest."

The Fontainebleau released a statement Thursday that said there is an investigation and the hotel is helping.

"The resort has, and will continue to provide, all available assistance to the authorities, as guest safety is our primary concern. This is an isolated incident and all known parties involved (alleged victim, alleged suspect and possible witnesses) have been identified, located and are part of the police investigation off property,” the statement said.

The victim's 911 call came in around 7 a.m. She is in town with her friends and her sister for the Ultra Music Festival.

Witnesses reported seeing a man placed in the back of a police car.

The investigation is ongoing.
