Cutler Bay Couple Arrested After Alleged 2014 Sexual Assault of Teen Girl From Spain

A Cutler Bay couple was arrested last week after disturbing allegations that they sexually assaulted a teen girl who had come to the United States from Spain in 2014.

Officers charged 50-year-old Dale Leary and 21-year-old Marta San Jose with multiple counts, including lewd and lascivious behavior on a child younger than 16, sexual performance with a child and contributing to the delinquency of a child.

According to the arrest report from Miami-Dade Police, the couple began having contact with the teen – described by officials as being 14 years old at the time of the alleged incidents – after she came to the U.S. in June of that year.

Police say that the couple had sex in front of the victim multiple times while later having Leary perform sex acts on both females and having San Jose and the victim perform sex acts on him.

The couple also is alleged to have given the victim alcohol and taken various photographs, including several nude photos with both women.

Both Leary and San Jose remain behind bars. The victim was reunited with family in Spain.

The couple met after Leary hosted San Jose as part of an international exchange program for students in 2012, when she was 16 years old. Police say Leary flew to Spain to convince San Jose’s parents to allow her to return to South Florida, divorcing his wife and marrying San Jose when she turned 18 less than two months before the alleged assaults.
