The Florida Times-Union reports that attorneys for 49-year-old Michael Dunn on Tuesday asked a Florida court of appeal to throw out his murder conviction and life sentence and grant a new trial.
Dunn was convicted of fatally shooting 17-year-old Jordan Davis after a confrontation sparked over loud music coming from the vehicle in which Davis was riding.
Dunn's attorney Terry Roberts argued for a new trial before a three-judge panel on Tuesday, saying prosecutors didn't refute Dunn's claim that Davis had threatened to kill him before the shooting.
Dunn was at the gas station after attending his son's wedding, where he had been drinking.
