Lawsuit Filed Over Casino's Range Rover Contest

A Range Rover is at the center of a lawsuit between a woman who said she won it and the Gulfstream Casino which said she violated the rules of the contest.

NBC 6 first told you about the story of Vicki Wersching and Gulfstream Casino in early August. Wersching said she received a promotional mailer with a key that could possibly unlock a box for a new car. She went to the casino and that’s when she said things went awry.

“The only rules were that you be over 21, have a valid Florida Driver’s License and check in at the player’s club and have a player’s club card, which I had,” Vicki said.

Wersching told NBC 6 in August that she pushed the key in until she felt it go all the way in and then “I turned it, the door opened, and then the siren went off so I assumed I won. I was pleasantly surprised.”

According to Wersching, a manager came to tell her that she actually didn’t win the car because the key she used didn’t open the box “smoothly.”

“She had to turn the box and clearly, she didn’t turn the lock seen through our surveillance and through our player representative who was standing there watching her,” said Michael Nyman of Gulfstream Casino. “She shook it open. She was never able to turn the key.”

According to Wersching, the player representative never told her anything which made her believe that she won the brand new Range Rover.

“That wasn’t the point, she did violate the rules and it was very clear on the mailer we sent. You had to unlock the lock,” Nyman said.

The casino emailed Vicki saying, “This is an obvious flaw in the construction of the box and we did not envision any rough handling of it, since the 5 keys easily and smoothly opened the door upon every test.”

“This key did open that box, that may have been defective by no fault of my clients,” said David Kubilium, Wersching’s attorney. “They should honor what the flier says and give her the Range Rover.”

Gulfstream Casino offered Wersching $500 to gamble at the casino, but she said that offer was unacceptable.
