Midtown Miami Walmart Still Coming Despite Court Loss

Opponents of a Walmart in Midtown Miami won a partial victory in court Monday over a permit, but the mega retailer still appears to be on track to build a store in the area.

Monday’s decision in the 11th Circuit in Miami-Dade County sends the city’s approval of the store back to the city for reconsideration on one issue. According to the court, the city zoning code would allow the store to have only three loading bays, not the five bays that were originally approved.

Even though the company will have to seek a new permit, Walmart said the court’s narrow ruling affirmed the other arguments for the store from the city and the retail giant.

“We are very pleased with today’s decision, which affirms nearly all of the arguments that Walmart and the City delivered to the court,” Walmart senior manager of communication Amanda Henneberg said in a statement. “We look forward to receiving an amended permit as soon as possible and will then move forward with constructing a store that provides access to affordable groceries and creates hundreds of new jobs.”

According to the Miami Herald, the proposed store will be roughly 200,000 square feet and will be located at the southern end of Midtown Miami.
