N. Fla. Man Who Killed Neighbor in Herbicide Dispute to Argue Self-Defense

A Gainesville man accused of killing his neighbor after a fight over the use of herbicide has been indicted and plans to defend himself using Florida's stand-your-ground law.

Police arrested 56-year-old Randall Smith on suspicion of murder after the 2014 shooting of his neighbor, 47-year-old Michael Carreiro.

State Attorney Bill Cervone tells the Gainesville Sun that the grand jury indicted Smith even after hearing his self-defense argument.

Smith's attorney Larry Turner says Carreiro had threatened Smith previously and again during the argument over the use of the herbicide on a shared easement to their homes.

Smith had called authorities prior to the shooting about the arguments and told officials he'd been threatened by Carreiro.

Cervone said Carreiro had no weapon and was shot a dozen times.
