Officer Seeks Release From Jail While Awaiting Trial on Rape Charge

A South Florida police officer is seeking his release from jail as he faces an accusation of rape.

Stephen Maiorino, 35, of the Boynton Beach Police Department was arrested in October after a 20-year-old woman said he raped her at gunpoint while on duty.

Maiorino is charged with two counts of sexual battery by a law enforcement officer with a firearm as well as armed kidnapping.

Maiorino's attorney says the sex was consensual. Boynton Beach Police Chief Jeffrey Katz says Maiorino is on unpaid leave and will be fired.

The Sun Sentinel reports a judge presided over a four-hour hearing Friday on the officer's request to be released while awaiting trial. She says she'll rule as quickly as she can.
