A transgender student at one Florida high school is suing the local school district after being told he had to use a restroom that was gender neutral.
The lawsuit was filed by Lambda Legal on behalf of 16-year-old Drew Adams, a rising junior at Nease High School in Ponte Vedra Beach, and his mother against the St. John’s County School Board.
In the suit, Adams’ attorney says that his client has been living as a male for the last two years and was using the boy’s bathrooms at the school without problem until an anonymous tip was made. After that, the teen was told he could no longer use those bathrooms.
“This conduct has a negative and harmful impact on Drew, branding him as unfit to share the communal restrooms that all other boys use simply because he is transgender,” the suit states.
The suit says the school district’s policy that restricts transgender students from being able to use the bathroom of the gender they identify with is a violation of the Equal Protection Clause of the 14th amendment as it is discrimination based on sex.
