A dramatic city hall plea from his owner wasn't enough to save beloved Miami Beach rooster Mr. Clucky from being banished from his roost.

Owner Mark Buckley lost his bid to keep Clucky in his home during a code-compliance hearing this morning.

Buckley had been given a citation in late May stating that he was illegally harboring farm animals in his home, and that Clucky would have to go out to pasture.

"What's the issue? He's kept quiet in the morning," said Buckley, who filed a petition for Clucky to stay. "I've never had a noise violation, I have affadavits from all my neighbors."

Buckley even organized a candlelight vigil last night in front of city hall, with protestors chanting and praying that Mr. Clucky would get to stay.

But now Buckley will have to pay a $50 fine and Cluckly can be plucked by code enforcement officers at any time, though Buckley can appeal the decision or try to get a special exemption.

"The judge will have their opinion but Mr. Clucky is in the right, and it's not going to be over that easy," Buckley said last night. "Mr. Clucky brings love, what are they complaining about?"
