It's five months before Halloween and already we've got our first Frankenstein story of the year.

A Tampa man has been charged with the rare desecration of a grave after a cemetery security guard caught him with several bones in his backpack.

Andres Sotelo-Rivera, 41, was arrested late Tuesday night, just days after a grave was found disturbed at Woodlawn Cemetery. The grave was from 1936 and police are not sure why Rivera wanted the remains.

Authorities say a security guard spotted the grave robber and another man walking away from that same tomb, but the two took off running. The guard chased Rivera and was able to hold him down until police arrived. The other suspect got away.

A tire iron, a hammer and human bones were found in Rivera's backpack. No other graves were disturbed.

Rivera was also charged with aggravated assault for attempting to hit the security guard with a brick.
