Attorneys For Dalia Dippolito File Motion For New Trial After Allegations of Sleeping Juror

Attorneys for a Palm Beach County woman convicted of trying to hire an undercover officer to kill her now ex-husband are asking for yet another trial after allegations that one juror slept through important moments during the last one.

The Palm Beach Post reported that lawyers for Dalia Dippolito filed a motion Thursday for that new trial, saying in their request that the alleged sleeping juror was allowed to stay despite their assertions that several people saw her sleeping and tried to wake her up during testimony.

Dippolito was convicted last week in the 2009 case, where she was caught on camera trying to hire who she thought was a hit man to kill her husband of six months, Michael.

If the motion is granted, it would lead to a fourth trial in the case. Dippolito was convicted in 2011 and sentenced to 20 years in prison, but that conviction was later overturned three years later. Jurors failed to reach a unanimous verdict during the second trial last year, while she was convicted during a third trial next week.

If the motion is denied, Dippolito is scheduled to be sentenced on July 21st, where she could face up to 20 years in prison.
