A burglar, who was caught in the act, was shot to death at a Miami home Wednesday by the would-be victim.

A man was home with his 3-year-old son around noon when he grabbed his gun as he heard someone breaking in, police said. The homeowner shot and killed the burglar trying to make his way into the duplex on Northwest 71st Street and 5th Place.

Cellphone video obtained by NBC 6 showed the alleged burglar lying dead outside the home as detectives processed the scene.

Miami police say they questioned the man who killed the suspect and later released him. No criminal charges were filed.
