Landlord Arrested for Allegedly Shooting Tenant: Miami Police

A dispute between a landlord and tenant exploded in gunfire during an eviction in Miami Tuesday, police said.

The shooting happened as the landlord was serving the eviction notice at an apartment building at 7825 Northwest 5th Court, Miami Police said.

The building owner said her son, the property manager, was serving the eviction and was removing furniture from a unit when the tenant stormed inside and started breaking things.

The woman, who didn't want to be identified, said the altercation escalated and her son pulled out a gun and shot the man in the leg.

The shooting victim was taken to Jackson Memorial Hospital where his condition was unknown.

Family members of the property manager, Gerard Rivera-Domenech, said he was arrested after the incident. They also said the couple evicted hasn't paid rent since May.

"He has been calling the police all the time. Because those people they don't pay," Rivera-Domenech's aunt told NBC 6.

A sign posted on the window of a car indicated police executed the court order for the eviction.

Domenech has been charged with aggravated battery and the use of a firearm while committing a felony.

His family is asking for a restraining order against the couple, who did not comment.

On Wednesday, a judge set bond at $15,000 for Domenech and also issued a stay-away order from the victim.
