A Miami appellate court ruled Wednesday that Miami Heat star Dwyane Wade's ex-wife Siovaughn Funches-Wade would not have to undergo a psychological examination, documents from the Third District Court of appeal said.
Wade, who filed for divorce in 2008, had asked a trial court in July to require Funches Wade submit to a mental evaluation and limit her parenting time, according to the documents. He said he was afraid the mother might "do something drastic to the children or herself" after Funches-Wade held a bizarre protest outside an Illinois courthouse where the two were still settling financial issues, read the court documents.
During her protest, Funches-Wade sat outside the courthouse with a sign that read "NBA MIAMI HEAT STAR MOTHER OF HIS CHILDREN ON THE STREETS" and spoke passionately with reporters about the custody battle.
The court ruled in favor of Funches-Wade, saying that, while the display may have misled people to think she was homeless, it merely showed a passionate mother voicing her opinion and was not reason enough to make her submit to a mental evaluation.
The court also disqualified Judge Antonio Martin who had ordered the evaluation.
