Lawyer Asks For Client's Murder Case to Be Thrown Out Based on Florida's Stand Your Ground Law

Prosecutors say Janespy Mesa Carballo killed Ilan Nissim because she believed he was involved in the 2008 murder of her husband.

A woman accused of killing a man in retaliation for her own husband's murder was in court Wednesday claiming the shooting was committed in self defense.

Prosecutors say Janespy Mesa Carballo killed Ilan Nissim because she believed he was involved in the 2008 murder of her husband Orlando Mesa. They say Mesa Carballo lured Nissim, who was being investigated as a possible suspect in her husband's murder, to her house to kill him.

Witness Jenny Thomas agrees with prosecutors. She said she overheard Mesa Carballo speaking to Nissim on the phone.

"Yes, she did, she asked him when is he coming, and matter of fact, I heard it twice," she told the courtroom.

Jury Set in Rilya Wilson Murder Trial

There was no way, Thomas said, that Mesa Carballo was standing her ground.

"I did not feel in any instance that she was actually afraid of him, it actually seemed like they were actually close friends," Thomas said.

Mesa Carballo says she shot Nissim multiple times in self defense because he forced his way into her house. She and her attorney want the case thrown out.

Police said Mesa had been arrested on drug charges but never convicted.

The hearing is expected to continue Monday.
