Man Accused of Beating Puppy Now Faces Prosecution

A South Florida man accused of beating a puppy to death is once again facing prosecution after an appeals court ruled that the dog's necropsy results can be presented at trial.

The Miami Herald reports that the Third District Court of Appeal on Wednesday overturned a Miami-Dade judge who previously ruled that police illegally seized the beagle puppy's remains from a veterinarian's clinic. Defense attorneys have claimed the necropsy was flawed and exaggerated.

Molly died in 2011 shortly after her owner, 28-year-old Matthew Milewski, brought her into a Miami Beach veterinary clinic. Milewski said the dog bit him while he was trying to clean her paw, and he dropped her in the shower.

Authorities say Milewski, who was charged with animal cruelty, repeatedly hit Molly with a leash, dragged her across a parking lot and slammed her into hard surfaces.
