Man Accused of Sniffing Feet at FIU Makes Court Appearance

The man with an apparent foot fetish, accused of smelling women's feet on a South Florida college campus, appeared before a Miami-Dade judge on Wednesday.

Eddy Juan, 52, was being held on charges of evading police. He's not facing any charges for the alleged foot incident, which put Florida International University on alert for days.

"You were arrested for aggravated assault on a law enforcement officer, fleeing and eluding a police officer at a high rate of speed," Judge Mindy Glazer said in court.

But, no charges for smelling feet. Defense Attorney Alex Michaels, while not involved in the case of Juan, explains, "I'm not surprised because I do not believe sniffing someone's feet is a crime."

Miami-Dade Police arrested Juan on Tuesday after he allegedly tried to flee during a traffic stop. FIU Police started looking for him two weeks ago, posting fliers and talking to students.

It was a female student who took cellphone pictures, accusing Juan of smelling her feet while she was in the school's library.

The court-appointed public defender told Juan to keep quiet about the case, "You don't want to speak to anyone from the media, from the TV station, radio stations, from the news stations."

Juan is a registered sex offender and according to the arrest report, he failed to register his vehicle, a scooter, with FDLE. But, why couldn't he face any charges for the alleged sniffing, like lewd and lascivious behavior or assault?

"There is no assault in sniffing someone around you," Michaels said.

Even under a library table in public? "No, I don't think it's anything sexual, maybe in his head, but legally, no."

The judge set Juan's bond at $18,500.
