A Miami man faced a judge on Tuesday after he was arrested for allegedly raping an underage girl.
Gamalier Lopez Vargas, 37, faces two charges in the case.
According to the arrest report, Lopez Vargas is accused of raping the 12-year-old. According to the report, he also faces a charge of having sex without informing the victim he has HIV.
The arrest report states the incident happened in May when the girl's mother left her alone. When she went to the grocery store, Lopez Vargas allegedly grabbed the girl from behind and tried to penetrate her. He's accused of then threatening to take her sister and move away, but she didn't comply.
However, police said Lopez Vargas did force himself on the girl.
This isn't the first time he's been accused of sexual assault.
Back in December, Lopez Vargas was released from jail after serving time for fake imprisonment, which stemmed from a rape accusation several years ago.

"The court has to take into consideration the danger to the community, along with the defendant's likelihood to appear in court," the judge said on Tuesday.
His bond was set at $75,000.
