Miami Beach Man Facing DUI Manslaughter Charge in Fatal MacArthur Causeway Crash

Jose Ernesto Dominguez, 26, surrendered to face charges in the fatal July 18 crash

A Miami Beach man is facing a DUI manslaughter charge in a crash on the MacArthur Causeway last month that killed one man and left another hospitalized.

Jose Ernesto Dominguez, 26, is also charged with DUI causing serious bodily injury in the July 18 crash, after turning himself in to police Monday, according to an arrest report.

According to the report, Dominguez was behind the wheel of his 2013 Ford Mustang convertible when he struck a Toyota Camry on the Causeway at the intersection of Fountain Street around 4:30 a.m. The report said Dominguez was driving "at a speed higher than the posted speed limit."

Two passengers in the Camry and Dominguez were hospitalized. One of the passengers, Danny Iglesias, was pronounced dead shortly after arriving at the hospital, while the second passenger suffered deep lacerations to his face.

Dominguez was treated and released from the hospital. Before he left, an officer met with Dominguez at the hospital and noticed he had bloodshot, watery eyes and a smell of alcohol "emitting from his facial area" as he spoke, the report said.

Dominguez told the officer he was on his way to meet someone and was in a hurry, the report said. He agreed to give two blood samples, which were taken one hour apart at about 6:20 a.m. and 7:14 a.m., the report said. The blood samples had a blood alcohol content of .070 and .051, according to the report.

"This result revealed that the subject had a metabolism rate of approximately .02 per hour; extrapolating these results, the subject's blood alcohol content would have been in excess of .08 at the time of the crash," the report said. "The totality of the circumstances revealed that the subject's normal faculties were impaired and he could not operate a motor vehicle safely on the date and time of this crash."

In bond court Tuesday, Dominguez's attorney said he works as a bartender, and called the crash " a very tragic accident." The judge set his bond at $35,000, and ordered him not to drink or drive pending the outcome of the case.
