Miami federal prosecutor won't be charged for dip in skivvies

A Miami federal prosecutor who was busted for swimming in a bar pool in his boxers and accused of exposing himself to a minor won't face charges for the incident.

The Miami-Dade State Attorney's office won't pursue a case against Sean Cronin, 36, who was arrested in September for the incident at Finnegan's on the River, according to the Miami Herald.

Cronin was watching the New England Patriots beat the Buffalo Bills on Sept. 26 when he decided to take a dip in his skivvies. But not everything stayed in his trousers when he got out of the water, according to the police report. His genitalia and rump were allegedly showing.

A woman and her daughter were sitting by the pool and the cops were called in.

Cronin even tried to make a wet getaway, police said, but was run down by officers after he jumped several fences. He was charged with misdemeanor lewd and lascivious exhibition and nonviolent obstruction of justice.

On Tuesday, the case was dropped after there was "insufficient evidence" that Cronin "intentionally exposed his genitals in a lewd or lascivious manner."

Cronin's lawyer called the case "fiction" and told the Herald that "he should have never been arrested in the first place," and that his client wasn't fleeing.

"If the police had conducted a proper investigation, they would have known the facts, which are that Mr. Cronin did nothing wrong," said attorney Joel Denaro. "Thankfully, the state agreed."

Cronin, who wasn't suspended, according to Denaro, still faces an administrative investigation for "misuse of authority and conduct unbecoming a federal law enforcement officer."
