A homeowner got into a shootout with an armed suspect in front of his Allapattah home Tuesday night as his young children and their mother were just steps away.
Surveillance video shows the couple and their two sons, 1 and 3 years old, arriving at their house near NW 27th Avenue when a man with a gun approaches them from behind.
The homeowner takes cover behind a car and starts shooting at the suspect as the suspect hides behind a tree.
Miami police said they are treating this as a "stand your ground" incident.
"Here it's a very, what seems to be, a very clear indication of a 'stand your ground case,'" attorney Diego Weiner said.
Mykece Johnekins, 22, faces a slew of charges including attempted first-degree murder, police said. He was shot at least once in the neck. Records show he is a convicted felon who was released from prison in January.
Every state that has a "stand your ground" law has a different burden of proof to justify using lethal force, and Weiner says in recent years Florida has added more protections for individuals in these cases.
