Three Suspects Face Judge After Allegedly Stealing Generator While Armed With BB Gun

Three people faced a Miami-Dade bond court judge on Tuesday – accused of stealing generator at BB gunpoint in Homestead.

Fidel Quintana, Danorris Dingle and Joseph Pereira are charged in the theft that occurred at the Northern Tools store.

The gun used in the crime was a BB gun, which prosecutors argued is a deadly weapon.

“It’s the state’s position that a BB gun is a deadly weapon," prosecutor Nessa Eth said.

“The co-defendant yelled out to Mr. Pereira ‘Yo, get the gun we got to shoot these’ and he said bad words ... then defendant Pereira began to search for the firearm in the vehicle," Miami-Dade Judge Mindy Glazer said during a court appearance.

However, Glazer did not conclude with the prosecutor's argument.

“There’s probable cause for armed robbery with a weapon, not a deadly weapon ... BB gun isn’t a deadly weapon," Glazer said.
