A hospital employee in Southwest Miami-Dade found himself behind bars after he allegedly sexually assaulted a mental health patient on New Year’s Eve in her room.

Fernando Ramos-Garcia was arrested Tuesday night and charged with four felony counts, including sexual battery as well as sexual misconduct inside a mental health facility. The 40-year-old bonded out before he was scheduled to appear before a judge.

According to an arrest report, Ramos-Garcia entered the victim’s room inside the Westchester General Hospital around 10 p.m. on Monday and forced her to perform oral sex on him.

Later, Ramos-Garcia walked to the doorway to see if anyone was coming before re-entering the room and allegedly covered the victim’s mouth before forcing her to have sex.

Ramos-Garcia admitted to both incidents when questioned by police, but claims they were consensual. He was arrested and booked into jail.

The hospital issued a statement saying it takes the safety of patients and the allegations "very seriously" and they would cooperate with the investigation.
