A man family members identified as 31-year-old Daniel Martinez is dead after being hit by a car while reportedly riding his bike away from a dispute Saturday night.
Police were able to track down a white car witnesses said veered deliberately into Martinez, finding and charging Jorge Lugo, 20, with first degree murder and aggravated battery with a deadly weapon.
The police report notes Martinez argued with several people at a convenience store in Homestead just before his death. An uncle told CBS that someone had attempted to rob Martinez' brother with a knife, prompting the argument, and family members indicated there had been previous friction between the two parties.
But Martinez was riding away from the store when, police say, Lugo swerved from the road and struck him. The father of two was pronounced dead at the scene.
