Judge to Rule Later on Middle School Killer's Resentencing

A judge will decide later this month whether to impose a new sentence on a South Florida man convicted of fatally stabbing his middle school friend when both were 14.

After a three-day hearing ended Friday, Miami-Dade Circuit Judge John Schlesinger said he will deliver his ruling Feb. 22 for 26-year-old Michael Hernandez.

Hernandez is seeking to reduce the life prison sentence he is serving for killing Jaime Gough in 2004 in a middle school bathroom.

The hearing was ordered after the U.S. Supreme Court ruled in 2012 that juveniles could not automatically be sentenced to life without chance of parole.

Hernandez took the witness stand Wednesday to apologize to the Gough family. He says he has an improved mental state and is no longer obsessed with death and becoming a serial killer.
