A Florida man facing a DUI charge told police officers he drove onto an unused portion of train track and was sideswiped by a passing commuter train while following GPS directions on Saturday night.
Luis Daniel Lopez Rojas, 19, escaped injury, and West Palm Beach police officers found him asleep behind the wheel, an arrest report said.
He was charged with DUI causing damage to property and later released from jail.
Two breath samples revealed that he had blood-alcohol levels of .184 and .177, more than than two times the state’s legal intoxication threshold of .08, the Palm Beach Post reported.
The collision happened along the CSX tracks. The side mirror was knocked off of the Mustang he was driving, according to the arrest report.
After police woke him up, they say he denied being on the tacks, then told officers he had been following GPS directions, the report said.
An officer said he detected the smell of alcohol on him. The report said he told officers he drank six beers while at home alone that night.
Jail records didn't list a lawyer for Rojas.
