Man Pleads Not Guilty in Mistaken Identity Rape Case

A man who was arrested in the kidnapping and rape of a teen in Miami-Dade after another man was cleared with the help of DNA evidence was in court Wednesday where he pleaded not guilty.

Miguel Bustos, 27, was officially arraigned on sexual battery and kidnapping charges related to the December 2014 incident.

Back in March, police had arrested Miguel Macias on the same charges thinking he was their suspect. The alleged victim had identified Macias from a Facebook post but Macias' DNA sample did not match a sample taken from the victim.

Prosecutors dropped all charges against Macias last month, around the same time Bustos was arrested.

Bustos had a prior arrest in 2011 for aggravated assault with a firearm and his information was in the criminal justice system.

Bustos remains behind bars without bond. He did ask the judge to set a bond so his attorney might schedule a special hearing to see if that's possible.
