Luis Rodriguez, 23 months old, was on life support at Holtz Children's Hospital at Jackson Memorial Hospital on Tuesday.

He was with his parents at the Paraiso Hotel in Hialeah on Friday night when he fell out of a second-story window.

In court on Tuesday, the boy's legal guardian said that currently, after speaking with medical staff, the boy had no brain activity. His parents were not at the hearing, and their attorneys said they were at the hospital.

As of right now Jacqueline Sanchez and Luis Rodriguez have each been charged with child neglect no great bodily harm, but not because of their toddler's two-story fall. Their arrest forms state that two bags of suspected cocaine and empty capsules of a suspected narcotic were in the hotel room within reach of the child.

Luis and his 5-month-old brother are both in the custody of the Department of Children and Families. The court is waiting for confirmation of brain death.

Hialeah Police are waiting for toxicology results from the toddler to see if he ingested any drugs found in the room.
