Fired Miami Police Chief Sues for His Job Back

Former Miami Police Chief Miguel Exposito on Tuesday filed a lawsuit against the city saying he was wrongly terminated

Former Miami Police Chief Miguel Exposito wants his job back and he's looking for a judge to grant him his wish.

On Tuesday, Exposito filed a lawsuit against the city claiming he was wrongly terminated from his job on Monday, Sept. 12.

Exposito cites two main reasons, one being, the city didn't have enough evidence to remove him from his psot. He also claims the city didn't follow its own time frame for removing him.

Miami City commisioner Frank Carollo told NBC Miami he kind of expected this development.

"There was always talk that there would be a possibility of some type of appeal and apparently the chief has chosen to appeal," Carollo said.

On Tuesday, Sept. 6, City Manager Johnny Martinez notified the chief that he was suspended from his job. According to the city charter, commissioners must hold a hearing within five days of suspsension to determine if the chief should be fired or not. The termination hearing started on Friday, Sept. 9. It concluded on Monday, Sept. 12.

Exposito claims in the lawsuit that the weekend days should've have been included in the five-day window, meaning his termination should've happened on or before Sunday, Sept. 11.

On the advice of the city attorney, commisioners excluded the weekend days and voted to terminate Exposito on Sept. 12.

Exposito's lawsuit said the only remedy to the controversy is for him to be reinstated as chief.

At City Hall on Tuesday, Mayor Tomas Regalado said he thought the drama was over.

"And it's a shame because now the city has spent resources, Mr. Exposito has to spend his resources, and its not right to put the people of Miami through this saga again," Regalado said.
