Judge Rejects Plea Agreement in Fatal MacArthur Causeway Crash

The driver accused of speeding more than 100 miles an hour and plowing into an SUV, killing his passenger, will now head to trial.

Andres Toro, accused of rear-ending his Lamborghini into an SUV on the MacArthur Causeway, was getting ready to settle the criminal case by taking a plea Friday.

His friend, Dr. Malcolm Lloyd, the passenger in Toro's car died on impact. The driver of the SUV was seriously injured but survived.

"A plea agreement with the State of Florida and we would like to proceed with the plea agreement," said Roy Black, Toro's defense attorney.

The judge rejected the plea agreement, which was reportedly less than the mandatory four years in state prison. So now the case is almost ready to go in front of a jury.

But first, defense attorneys are filing legal motions in January to suppress blood evidence. According to the arrest report, Toro's blood alcohol level was .20, almost three times the legal limit, and he was driving in excess of 100 miles an hour.

Famed defense attorney Roy Black quickly left after the hearing, "I'm not going to comment on the matter, thank you."

If the case goes to trial, Toro faces a maximum sentence of 21 years in prison, if convicted of all charges.
