Teen Testifies That Miramar Police Captain Made Her Strip Naked To Prove She Wasn't Having Sex

Opening arguments were given in the trial of Capt. Juan de los Rios, 46, who faces two counts of lewd or lascivious conduct

A now 16-year-girl said that a Miramar Police captain made her strip naked and expose her genitalia to prove she was not having sexual intercourse in a parked car as testimony began in his trial Tuesday.

The teen took the stand during opening arguments in the trial of Miramar Police Capt. Juan de los Rios, 46, who faces two counts of lewd or lascivious conduct. She recounted the incident that authorities said took place in an industrial park off Miramar Parkway on Jan. 18, 2012.

"He asked me to pull down my pants, and my underwear, and to turn and face him towards the window, and I said, 'Why?' He didn't believe that we weren't having sex," she said, fighting back tears.

The teen also claimed de los Rios used a flashlight to examine the then-15-year-old's genitals before allowing her to leave with her male friend who was 19 at the time. Initially, the teens told authorities they were just talking when De Los Rios approached their car, but an investigation found they were at least kissing. Attorneys for the officer said they believe the teen couple was hiding critical details to cover up their illegal sexual relationship because the girl was underage.

"They affirmatively lie and withhold information that they had been having a sexual relationship that went back until she was 14 years of age," defense attorney Alberto Milian said.

The defense claimed the victim's initial description did not even match de los Rios, who was later identified in a lineup. While under examination by prosecutors, the victim's then-boyfriend, Steven Gaynor Jr., told the court that de los Rios is indeed the suspect.

The trial resumes Wednesday.
