Cops: man broke neck of Miami father whose daughter picked forbidden fruit

A Miami Beach man is still recuperating nearly three weeks after a fight over a tomato nearly killed him.

Robert Lerner didn't expect to be fighting for his life when he let his 10-year-old daughter pick a tomato off a roadside plant during a trip to the Redlands on Jan. 28.

The 44-year-old father suffered a fractured neck and spinal column after a man claiming to be the tomato plant's owner viciously attacked him, according to the Miami-Dade Police Department.

Lerner and his daughter had stopped at a tomato grove in the area of SW 228th Street, when the suspect confronted them and the beating ensued.

After he slammed Lerner to the ground, the suspect fled the scene. Police are still looking for him, and describe him as a white male between 40-60 years old about 5-foot-9 and 175 lbs. He left the scene in a dark-colored Jeep Wrangler.
