Man in Custody After SWAT Team Standoff in Miami Gardens: Police

Franklin Bain, 49, was apprehended without incident, police said

A man wanted on a search warrant was taken into custody without incident after he barricaded himself and held his daughter captive inside his Miami Gardens home Tuesday, police said.

A Miami-Dade Police SWAT team descended on the neighborhood as police sought to apprehend Franklin Bain, 49, who was inside 20409 Northwest 27th Court, police said.

His 27-year-old daughter Francis was seen walking away from the home with police before the hours-long standoff ended. Detectives said she was being held captive during the standoff. She returned to the home Wedneday morning to look for her pet cats, but did not wish to speak with reporters.

A large area was cordoned off in the neighborhood, and a "temporary flight restriction" was put in place by the Federal Aviation Administration at the SWAT team's request, police said.

Miami Gardens Police said just after 6 p.m. that Bain (below) was in custody.

A neighbor recorded cell phone video of the SWAT team asking Bain to give himself up. He would not, and police fired chemical agents into the home.

"The grenades in. I'd say about 20 of them went in. They did it twice. Still no response, he didn't come out,” said the neighbor, who would only give her first name of Lori.

She said a second round of tear gas proved too much for Bain – forcing him out.

Tear gas canisters littered the yard afterward.

On Monday the department executed a search warrant for Bain for an armed sexual assault, but he managed to elude police. Officers returned to his home Tuesday.

"We received a call approximately 12:30 this afternoon from her boyfriend because she texted her boyfriend advising that her dad (was) holding her against her will," Wright said.

As the standoff unfolded, police said that they believed Bain was armed and dangerous.

Traffic was shut down on a portion of Northwest 27th Avenue in Miami Gardens in both directions because of the incident, police said.

Bain has a long history of criminal charges -- 27 total from 1983 to 1999 -- which include assault with a deadly weapon, battery and child abuse.
